Terms and Conditions
1. GENERAL TERMS
1.1 Definitions: In this agreement:
- Client refers to the individual(s), company, or organization receiving services from RedMed First Aid Training as outlined in these terms.
- Booking Form signifies the form completed to arrange the Service.
- Service or Course denotes a first aid training course.
2. Service Provision: Red Med First Aid Training agrees to deliver the Service at the Client’s selected location, in accordance with these terms. Any amendments to the Service or these terms must be mutually agreed upon in writing by both parties.
3. Client Responsibilities: The Client must provide RedMed First Aid Training with all necessary details, documentation, and materials, in a timely manner, to facilitate the Service as per the Booking. The Client is responsible for ensuring the accuracy of all provided information.
4. Service Specification: The Service will be provided as outlined in RedMed First Aid Training’s current brochure or other relevant publications, subject to these terms.
5. Corrections: Red Med First Aid Training may amend any errors or omissions in brochures, promotional materials, quotes, or other documents related to the Service without liability.
6. Service Modifications: RedMed First Aid Training reserves the right to modify the Service without notifying the Client if such changes are necessary to meet safety or legal requirements or if they do not significantly alter the quality or nature of the Service.
7. FEES AND PAYMENT TERMS
7.1 General Fees: The Client agrees to pay the fees charged by RedMed First Aid Training for the Service, along with any additional costs agreed upon for providing the Service. Fees must be paid in full at the time of booking to secure dates, especially for courses spanning multiple weeks.
7.2 Fee Adjustments: RedMed First Aid Training may alter its fees with at least two months’ written notice to the Client.
7.3 Quote Validity: All fee quotes provided to the Client are valid for 30 days.
7.4 Group Bookings: Provisional bookings for group courses may be made by phone but must be confirmed within seven days by submitting a Booking Form. A 50% deposit is required to secure course dates. The remaining balance is due six weeks before the course begins. Full payment is required at the time of booking for multi-week courses to guarantee dates. Individual bookings are only confirmed upon receipt of full payment.
7.5 Overdue Payments: RedMed First Aid Training reserves the right to charge interest on overdue payments at a rate of 4% above the current Lloyds TSB Bank base rate. Interest will accrue daily.
7.6 Travel Expenses: For training at the Client’s location, travel expenses will be charged at 41 pence per mile. Trainers may share transport to minimize costs.
7.8 Accommodation Costs: Training held more than 40 miles from the Trainer’s residence requires the Client to cover accommodation costs for the Trainer, with one night’s stay required per training day. These expenses will be included in the final quote and agreed upon in advance.
8. CLIENT CANCELLATIONS OR POSTPONEMENTS:
Cancellations by the Client must be in writing. No fees are due if the cancellation is made more than 21 days before the course start date. Cancellations within 21 days of the start date may incur charges:
- 14-20 days notice: 25% of the course fee
- 7-13 days notice: 50% of the course fee
- 2-6 days notice: 75% of the course fee
- Less than 2 days notice: 100% of the course fee
For cancellations within 14 days of the start date, additional venue fees may also apply. In exceptional cases, courses may be postponed rather than canceled at the discretion of RedMed First Aid Training. If rescheduled within 7 days, no cancellation fees will apply, but subsequent cancellations of the rescheduled course will incur a 100% fee.
9. CANCELLATION BY RED MED FIRST AID TRAINING:
If RedMed First Aid Training needs to cancel or postpone a course, the Client will be notified as soon as possible. The Client may choose between:
- A full refund (if the course has not started)
- A proportional refund (if the course has started)
- An alternative course date
RedMed First Aid Training is not liable for delays or failures in Service due to circumstances beyond their control.
10. NON-ATTENDANCE:
If a student does not attend the course, the Client remains responsible for the full course fee. A substitute student may be provided by the Client if the course has not started. If the course has begun and a student cannot complete it due to exceptional circumstances (e.g., illness with a doctor’s note), an alternative date may be arranged.
11. STUDENT SUITABILITY:
The Client must inform RedMed First Aid Training of any special student requirements before the course starts. If a student is deemed unsuitable by the Trainer, they may be asked to leave the course. The Client is also responsible for providing a suitable training environment if the course is held at their venue.
12. INSURANCE:
Insurance is public liability for £2 million and professional indemnity £1 million.
13. HEALTH AND SAFETY:
The Client must ensure that the training venue complies with all relevant health and safety regulations. RedMed First Aid Training will require details of the training room before the course is confirmed. Students will be informed of any potential hazards during the course.
14. LIABILITY:
14.1 Service Quality: RedMed First Aid Training guarantees that the Service will be provided with reasonable care and skill.
14.2 Third-Party Goods: RedMed First Aid Training does not guarantee the quality or suitability of any third-party goods supplied with the Service.
14.3 Client Liability: RedMed First Aid Training is not liable for any loss, damage, or costs resulting from incorrect or incomplete information provided by the Client.
14.4 Limitation of Liability: Except in cases of death or personal injury caused by RedMed First Aid Training’s negligence, the company’s liability is limited to the amount paid for the Service.
15. TERMS MODIFICATION:
RedMed First Aid Training reserves the right to change these terms without prior notice. These terms are governed by English Law, and any disputes will be resolved under the jurisdiction of English Courts.
16. GENERAL PROVISIONS:
16.1 Entire Agreement: These terms constitute the entire agreement between the parties, superseding all prior agreements.
16.2 Notices: Notices must be given in writing and sent to the registered address or principal place of business of the relevant party.
16.3 Waivers: RedMed First Aid Training’s failure to exercise any right under these terms does not constitute a waiver of that right.
16.4 Severability: If any provision of these terms is found to be invalid, the remaining provisions shall continue to be effective.
16.5 Dispute Resolution: Disputes arising under these terms will be resolved by arbitration.
16.6 Certification: On completion of course and all fees settled the client will receive an e certificate with a hard copy provided on request at an additional cost.
